Changes to a Government Contract can occur by a unilateral writing of the Contracting Officer, or through Government action/inaction. Any change in work specifications, a change in delivery methods, or any other action which impact the cost or time to perform the Contract – often both – entitles a Contractor to relief. When a Change presents itself, the Contractor must act to protect itself, principally by noticing the Contracting Officer. Without providing a timely Change Notice, the Contractor may be left without its available contractual remedies. After notice, the Contractor must request an equitable adjustment to the Contract. If that request is denied, the Contractor may file then seek its remedy by filing a Claim with one of the Boards of Contract Appeal or the Court of Federal Claims.
